The Plenum of the Supreme Court of the Republic of Belarus considered the issue of judicial practice of replacing punishment
The Plenum of the Supreme Court of the Republic of Belarus discussed the judicial practice of replacing sentences with more severe ones in cases of malicious evasion. As Chairman of the Supreme Court of the Republic of Belarus Andrei Shved noted that this issue required a more principled approach. He stated that general trend has emerged toward mitigating punishment and liability on the one hand, and prompt legislative responses to new challenges related to public safety on the other. Consequently, public demand for an adequate approach to the measures taken is also being formed. The Criminal Procedure Law provides for a special procedure for courts to consider issues of replacing sentences with more severe ones during the execution of a sentence. The Plenum's deliberations will result in the adoption of a resolution providing a structured explanation to the courts regarding law enforcement.
